Party Wall Agreements: What They Are and When You Need One

If you’re planning any construction or renovation work that involves a shared wall or boundary with a neighbour, you may need a Party Wall Agreement. These agreements are essential legal documents that help prevent disputes and misunderstandings when building works affect adjoining properties.

But what exactly is a Party Wall Agreement, when is it required, and what’s involved in the process? In this guide, we’ll explain everything homeowners and developers need to know — particularly when it comes to legal compliance and protecting your property interests.

What Is a Party Wall Agreement?

A Party Wall Agreement, also referred to as a Party Wall Notice or Party Wall Award, is a legally binding document between property owners who share a wall, fence, or floor. It’s a requirement under the Party Wall etc. Act 1996, which applies throughout England and Wales.

This act is designed to ensure that any works carried out to a shared structure or boundary are communicated clearly and agreed upon in advance by all affected parties.

When Is a Party Wall Agreement Required?

You’ll typically need a Party Wall Agreement if your planned works fall into one of the following categories:

  • Building a new wall on or at the boundary of two properties
  • Cutting into a party wall (e.g. for a beam or flashing)
  • Removing a chimney breast attached to a party wall
  • Excavating within 3 to 6 metres of a neighbouring structure, depending on the depth of foundations
  • Increasing the height or thickness of a party wall
  • Carrying out damp-proofing works to a party wall

If your work falls into any of these categories, you’re legally required to serve notice to your neighbour(s), usually two months before the work begins.

What Happens After Serving Notice?

Once you’ve served the appropriate Party Wall Notice, your neighbour has 14 days to respond. They can:

Consent – No further action is needed, and work can proceed.

Dissent – They can request a Party Wall Surveyor to be appointed (either one surveyor acting for both parties, or a separate surveyor for each owner).

Do nothing – This is treated as dissent, and surveyors will need to be appointed.

The Role of the Party Wall Surveyor

If there’s a dispute or lack of consent, a Party Wall Surveyor will draw up a Party Wall Award. This document outlines:

  • The scope of proposed work
  • The timeframe in which the work must be carried out
  • Protective measures for the adjoining property
  • The condition of neighbouring properties (via a schedule of condition)

The surveyor must act impartially, even if appointed by only one party. At Imperium, we provide expert party wall surveyor services, ensuring fairness and compliance with the law.

What Are the Consequences of Ignoring Party Wall Requirements?

Failing to obtain a Party Wall Agreement when it’s required can lead to serious legal and financial consequences. Your neighbour could seek an injunction to stop your work, or even claim damages if their property is affected. It’s always better to be proactive and ensure all necessary procedures are followed.
